We want everyone to have fun using our service. This is important as much as your safety and privacy are. We do ask you therefore to follow the following line of conducts:
1. While in 3Djay, you must respect the rights of others and their rights to enjoy 3djay Virtual World. You may not defraud, harass, threaten, impersonate, give unwanted attention or cause distress to other members.
2. You may not use sexually explicit, harassing, threatening, harmful, abusive, obscene, defamatory, hateful, racially or ethnically offensive language, in any language.
3. You may not post, upload or link to any sexually explicit, harassing, threatening, harmful, abusive, obscene, defamatory, hateful, racially or ethnically offensive imagery or content. You may not post, upload or link to any uncovered genitalia at all.
4. While in 3DJay, you may not spam or flood the chat, comments, or forums with repetitive text or obscene language.
5. You may not use information gathered on 3Djay to spam other members with offers of goods or services.
6. You may not impersonate any employee or representative of 3Djay.
7. You may not violate any local, state, national, or international laws or regulations.
8. You must follow the instructions of any 3Djay employee or representative while in 3Djay.
9. You may not misrepresent your age in any way if this crosses the boundary of the adult/minor threshold of 18 years of age. This includes: your profile, sharing your account with someone younger or older than you, chat in world, private messages, etc.
10. You may not attempt to interfere with, hack into, or decipher any transmissions to or from the servers running the 3Djay service.
11. You may not attempt to exploit any bug in the 3Djay service and you will not communicate the existence of any such exploitable bug to other users, instead immediately reporting any bug to support@3djay.com.
12. You may not release any real-life information about any other members or any 3Djay employees or representatives.
13. You may not create duplicate threads about the same topic on the forums. This includes threads about other threads that were closed by a forum administrator.
14. You may not create posts or threads concerning disciplinary action taken against any member of the community, including chat logs, personal messages, bulletins, or emails between that member and the 3Djay employee. While we welcome criticism about what you find in 3Djay, you may not post this criticism as a personal attack against any member or employee of 3Djay. We welcome all feedback and suggestions presented in the proper format because we DO want to create the best experience for all of 3Djay members.
16. Restricted items include: nonsexual nudity, profanity, substance abuse or graphic violence. 3Djay reserves the right to deem what is and isn’t restricted material and reserves the right to delete this material without notification.
17. Material that will not be allowed, restricted format or otherwise, includes but is not exclusive to the following: incendiary material, racial, ethnic or religious slurs and pornographic content or any depiction thereof.
19. Falsely reporting another 3Djay member is not allowed. You may not falsely report members for things they have not done. We do consider this a form of harassment.
20. You may not post private conversations between yourself and any other 3djay member, employee or 3Djay representative. These include in world, 2D Private Messages or any other forms of communication within 3Djay Website. You may not post these on the Forums, on your profile page or upload them as media. You CAN however, take screen shots to send to reports@3djay.com if you need to report someone for breaking the Rules of Conduct.
21.We do our best to ensure a level of consistency, but there must be a level of subjectivity involved in these types of issues. We will review each situation individually and how we address the situation is dependent upon the individual set of circumstances. Overall, our primary goal is to provide the support necessary to help ensure the best member experience.
22. Our members are expected to follow traditionally accepted rules governing contact between adults and minors (anyone under 18). A few examples of the type of behavior we find to be in violation of these guidelines includes, but is not limited to: use of obscenities, use of profanity, verbal assault, disruption of conversational flow (i.e., repeatedly posting the same text message), sexual harassment, racial and religious slurs, pornographic and obscene language and/or images, defamation of character
23.These Terms of Service are subject of the contract between the member and the company. By filling out the registration, you will become a member of 3Djay.
24. By using 3Djay ("Software"), developed and operated by Prototerra, you agree to comply with the following terms and conditions. You must be thirteen (13) years or older to participate. If you are younger than eighteen (18) years, depending on your jurisdiction, you must have permission by your parents or legal guardian, to use this service.
25.3Djay respects the intellectual property rights of others and we require that our members do the same. Members may not upload, post, reproduce, link to, distribute or store material protected by copyright, trademark, trade secret or other proprietary right, or which would violate any right of publicity, right of privacy or other right of any third party, without first obtaining permission of the owner of such right.
26. Deejay's agree to adhere to the Digital Millenium Copyright Act (DMCA) in accordance to any copyrighted material by either providing a license stating they own the rights to play the material and/or stream through Livestream (formally Mogulus) abiding by their copyright agreement. Any music streamed by 365 radio or other streaming service, the Deejay will then agree to provide a license via email to 3djay verifying they have the legal rights obtained through their streaming services.
27.3Djay adheres to the Digital Millenium Copyright Act (DMCA) and other applicable intellectual property laws. If you believe that any material on www.3Djay.com infringes a copyright that you own or control you may file a Notification of Claimed Infringement at reports@3djay.com
28.Copyright Notification – Official Notification of Claimed Infringement
Any notification of claimed infringement (“Notification”) must be submitted in writing to 3Djay at reports@3djay.com. Notifications that comply with the DMCA will assist us in quickly responding to your request. Please include the following information in your written Notification:
1. Provide information such as your name, address, phone number, and/or email address, which will allow 3Djay to contact you in writing.
2. Identify the copyrighted work that you believe has been infringed or, if you believe multiple copyrighted works have been infringed, a representative list of such works.
3. Identify the material, activity or product that you claim is infringing the copyrighted work(s) listed in your response to No.1 above, and provide information reasonably sufficient for us to locate the material, such as the URL.
4. Include the following statement: “I have a good faith belief that use of the material set forth above is not authorized by the copyright owner, its agent, or the law.”
5. Include the following statement: “The information in the notification is accurate, and I swear, under penalty of perjury, that I am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”
6. Apply your physical or electronic signature to the Notification.
7. Send the written Notice to reports@3Djay.com.
Failure to include all of the above-listed information in your Notification may result in a delay of the processing of your request or our inability to process your request at all. If you knowingly materially misrepresent that the challenged product is infringing your copyright(s) you may be liable for damages, including costs and attorney’s fees incurred by 3Djay and/or the alleged infringer. If you have any question that the challenged product infringes your intellectual property rights, please consult with an attorney.
29.3Djay reserves the right to change the Code of Conduct. If you do not agree with the changes, you can cancel your membership at any time. If you continue to use 3Djay with the knowledge of any such changes, it will be taken as your silent agreement with the changed Terms of Service
